  1. Subject of the contract
    1. paged, SciTech GmbH i.G., Aachenerstrasse 545, 50933 Cologne, Germany ("paged") offers a service that enables users to change the layout of web pages of paged's customers ("web pages") and to adapt them to the user's needs ("service"). This is intended to make these Websites more accessible to users with cognitive disabilities and to promote inclusion on the Internet
    2. This Service, which is free of charge to the User, will be implemented on the websites of paged's customers and may then be used by the User with or without a paged account ("User Account").
    3. These Terms of Use apply to the use of the Service with and without a User Account.
  2. Registration for a User Account/Conclusion of the Agreement
    1. The User may register with paged and create a User Account. With such a user account, the user's layout settings can be saved and applied to other devices.
    2. The user makes a binding offer to register for the opening of a user account by providing all information marked as required for registration, entering a valid e-mail address and a password that meets the requirements specified therein, and clicking on the registration button ("Register"). Until clicking on this button, the user can cancel the registration process at any time or change the information provided by deleting, adding or correcting the information provided in the various fields or closing his web browser or tab. After completing the registration process, the user can change the information provided in the user account at any time.
    3. The contract is concluded when the user has confirmed his e-mail address as well as the registration.
    4. paged will provide the services immediately after the conclusion of the contract.
    5. paged will communicate with the user - if necessary - mainly via the e-mail provided during the registration process. The User agrees to communicate with paged electronically. The user agrees to receive all communications from paged electronically. The User is responsible for ensuring that he/she is able to receive e-mails from paged.
    6. paged reserves the right to immediately suspend or terminate the user's account if the user violates these Terms of Use.
    7. The User may terminate his/her User Account at any time by contacting paged via support@paged.website or by deleting the User Account via the account settings. Upon such request, paged will close the user account as soon as possible.
    8. paged also reserves the right to terminate accounts that have been inactive for more than twelve months.
  3. Duties of the user
    1. User is responsible for taking all reasonable steps to maintain the security of User's account, including maintaining the confidentiality of User's password.
    2. User shall not use the Service for any illegal activity.
    3. The User shall not intentionally or negligently cause any interference, interruption or damage to the Service, and in particular, the User agrees to take all reasonable steps to prevent the introduction of viruses, malware or the like into the systems of paged or other users.
  4. Obligations of paged
    1. paged undertakes to exercise reasonable skill and care in the provision of the Service.
    2. paged shall endeavor to make the Service available to the User at all times.
    3. In addition, paged makes no express or implied promises with respect to the Service that it will meet the User's requirements or operate in an uninterrupted, timely, secure or error-free manner.
    4. In particular, paged assumes no responsibility for the websites and the content displayed thereon. Paged has no control over and assumes no responsibility for the content, accuracy, privacy policies or practices, or opinions expressed on third party websites or by third parties with whom User interacts. In addition, paged does not monitor, verify, censor or edit the content of any of its customers' websites.
  5. Warranty
      paged provides the Service to User on an "as is" basis, without warranty, due to the fact that the Service is provided free of charge. User uses the Service at User's own risk.
  6. Liability
    1. In the event of intent or gross negligence, paged shall be liable in accordance with the statutory provisions.
    2. In the case of ordinary negligence, paged shall only be liable to the extent that it is a violation of a material contractual obligation. In this case, paged's liability shall be limited to the foreseeable damage typical for the contract. An essential contractual obligation is an obligation, the fulfillment of which enables the proper execution of a contract in the first place and on the compliance of which the other party may regularly rely.
    3. Claims for damages under the Product Liability Act and in the event of injury to life, limb or health shall remain unaffected by the above limitations of liability.
    4. The above limitations of liability shall also apply in favor of paged's legal representatives, employees and vicarious agents.
  7. Right of Withdrawal
    • If the user is a consumer in the sense of § 13 BGB (German Civil Code), the following right of revocation applies to the user:

      • You have the right to revoke this contract within fourteen days without giving any reason.
      • The revocation period is fourteen days from the day of the conclusion of the contract.
      • To exercise your right of withdrawal, you must inform us (paged, SciTech GmbH i.G., Aachenerstrasse 545, 50933 Cologne, Germany) of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post, fax or e-mail). For this purpose, you may use the enclosed sample revocation form, which, however, is not mandatory.
      • In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
      • Consequences of the revocation
      • If you revoke this contract, we shall reimburse you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and no later than within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment.
      • If you have requested that the services begin during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you notify us of the exercise of the right of withdrawal with respect to this contract compared to the total scope of the services provided for in the contract.

  8. Privacy policy
    • paged informs users in the Privacy Policy how the user's personal data is processed.
  9. Changes and adjustment
    1. In order to provide the User with the best possible experience and service, paged will continuously develop its services. paged will inform the User in a reasonable manner of any material changes to the Service. Such changes will not affect the User's prior use of the Service. If User is dissatisfied with any changes made by paged, User shall be free to discontinue use of the Services.
    2. From time to time, paged may also need to make changes to these Terms of Use. paged will provide User with reasonable notice of any changes to these Terms of Use. Such changes will not affect the User's prior use of the Services. If User is dissatisfied with any changes made by paged, User is free to terminate his or her account.
    3. paged reserves the right to discontinue the Service at any time.
  10. Mandatory information on consumer dispute resolution
    • The EU Commission provides an online platform for online complaints (ODR platform). It can be accessed at https://ec.europa.eu/consumers/odr/ paged is neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.
  11. Final Provisions
    1. These Terms of Use shall be governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods and conflict of laws provisions. If the user is a consumer within the meaning of Section 13 of the German Civil Code (BGB), mandatory statutory consumer protection provisions under the law of the country in which the consumer has his habitual residence shall remain unaffected.
    2. The exclusive place of jurisdiction for all disputes arising from or in connection with this agreement shall be Cologne, Germany, provided that the contracting parties are merchants, the user does not have a general place of jurisdiction in Germany or in another EU member state, his permanent place of residence has been moved abroad after these General Terms and Conditions came into force, or his place of residence or habitual abode is unknown at the time the action is brought. Otherwise, the place of jurisdiction shall be determined in accordance with the general rules.
